Privacy Notice for California Residents

This Privacy Notice for California Residents supplements the information contained in Redmax's existing Privacy Policy located here, and applies solely to individuals who reside in the State of California ("consumers" or "you") as of January 1, 2020. We are providing this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Consumer Privacy Rights Act of 2020 (“CPRA”),  and any terms defined in the CCPA will have the same meaning when used in this notice.

Please see our existing Privacy Policy located here to know what categories of information we collect, why we collect your information, how we collect and use your information, types of third parties with whom we share your information and why your information is shared.

Your Right to Know

You have the right to request the following information, including information about how we have collected and used your Personal Information during the past 12 months. You may, at no cost, exercise your Right to Know only twice within a 12-month period. You have the right to request:

  • The categories of Personal Information that we have collected.
  • The categories of sources from which we collected Personal Information.
  • The business or commercial purpose for collecting and/or selling Personal Information.
  • The categories of third parties with whom we share Personal Information.
  • Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third-party recipient.
  • Whether we have sold your Personal Information, and if so, the categories of Personal Information received by each category of third-party recipient.

Your Right to Deletion

You have the right to request that we delete the personal information that we have collected about you.

Your Right to Correction

You have the right to request corrections of any inaccuracies in your Personal Information.

Your Right to Access/Portability

You have the right to request a copy of the Personal Information that we have collected about you.

You are entitled to exercise your CCPA and CPRA privacy rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our services.

How to Exercise Your Rights

You may request to exercise your California privacy rights as described in the U.S. Privacy Policy or using the information provided in Contact Information below. You do not need to create an account with us to exercise your rights.

We are happy to process your privacy rights requests. We will process all non-verifiable requests consistent with the requirements of the CCPA and our internal processes.

Verifiable requests will only be processed after we have confirmed your identity and validated that you reside in California. As part of this process, if we require verification to process your request, we will first attempt to do so by comparing the information within your request to the information we have on record. If we are unable to verify your identity after this comparison, we will contact you to request additional verification, as permitted by law. If you are unable to verify your identity after we contact you for additional verification, we reserve the right to deny your rights request, consistent with applicable law.

Consistent with the CCPA, you may also designate an authorized agent to make a request on your behalf. If you designate an authorized agent to make a verifiable rights request on your behalf, in addition to the verification methods described above, we will require the agent provide us with a written instrument demonstrating you have authorized them to act on your behalf.

For all verifiable requests, we will only require verification in compliance with the CCPA and in proportion to any potential risk to you from complying with the request.

For all requests, we cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

If you are somehow affiliated with us, in that perhaps you are an employee, vendor, contractor, or hold any other position for or within the Company, and you reside in California, you may exercise your CCPA rights using the methods detailed in this section. Note that privacy rights requests are not the mechanism through which you may request human resource-related information or other (examples include payroll, PTO, benefits, contract information); therefore, we cannot provide you such information, but we will process your privacy rights request in the same manner that we would for any other California Resident. Requesting to exercise your CCPA and CPRA privacy rights will not change the affiliation you have with us in any way.

Your California privacy rights are not absolute, and in certain cases we may decline your request as permitted by law. For example, we may deny privacy rights requests if there is any suspected malice, including any which may be deceptive, fraudulent, illegal, or pose a security threat. We may also deny requests related to legal or criminal matters, or if they are related to any in-progress transactions or purchases. You may appeal a denial of your privacy rights request as provided in our Privacy Policy above.

Response Time

We will acknowledge Your Right to Know, Right to Correction or Your Right to Deletion within 10 days of receiving your request. We will strive to respond to your request with the information you want to know or the detail of the information that we have deleted, within forty-five (45) days of receipt of your initial request. If we require more time, we will explain why an extension is necessary and the additional time needed, but no more than an additional 45 days to process the request. If we cannot comply with your request, we will explain why.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

We do not ordinarily charge a fee to process or respond to your request, but if we determine that the request warrants a fee, , i.e., because your request is manifestly unfounded or excessive, in particular because of their repetitive character,  we will tell you why and provide you with a cost estimate before completing your request.

Opt-Out Rights

While we do not sell or share your personal information in exchange for monetary consideration, we may sell or share your personal information for other valuable consideration. You have the right to tell us NOT to sell or share your personal information. You have the full and free right to opt-out of our disclosure of your personal information to any third parties where the disclosure constitutes “selling” or “sharing” as defined by the California Privacy Rights Act. You may exercise your right to opt-out without fear of discrimination for doing so. To opt-out of our selling or sharing of your information, meaning, we will not disclose your information to third parties for any monetary or other valuable consideration, you can do any of the following: 

  • Click here to be taken to an online opt-out submission form.
  • Visit any RedMax location in California to request a paper opt-out submission form.
  • You can use a universal opt -out mechanism, including the Global Privacy Control (GPC) signal. RedMax will process opt-out preferences from such signals, which are in formats commonly used and recognized by businesses, such as an HTTP field header, as requests to opt-out of sale or sharing. The signal opt-out will only apply to the browser you are using on your device; it will not apply to other browsers and/or devices to which signals are not activated or to offline sales.
  • You may also have an authorized agent submit a request on your behalf. The authorized agent may call our toll-free privacy line at (833) 674-9153 to make the opt-out request and for directions for submitting the proof of authorization and the authorized agent’s proof of identification to us. We maintain the right to deny a verifiable request from an authorized agent that does not submit sufficient proof that they have been authorized by you to act on your behalf.
  • If you are unable to submit an opt-out through any of the above methods, please call our toll-free privacy line at (833) 674-9153 for assistance and a representative will assist in meeting your needs.

A request to opt-out is not a verifiable consumer request. However, we may deny a request to opt-out if we have a good faith, reasonable, and documented belief that a request to opt-out is fraudulent. If we deny your request to opt-out, we will inform you of our decision not to comply and provide an explanation as to why we believe the request is fraudulent.

As noted in our Privacy Policy above, our Services are not intended for individuals under the age of 18 years old. Accordingly, we do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization from either the consumer that is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age [upon the parent or guardian providing sufficient evidence to verify such authority]. Consumers that opt-in to personal information sales may opt-out of future sales at any time. If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time or may have your authorized agent to do so on your behalf, by submitting the form at the link below:

CCPA Request Form here. Once you make an opt-out request, we will act upon your request within 15 days of our receipt of your request.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination Rights

We will not discriminate against you for exercising any of your rights under the CCPA. But we may offer a different price or service that is reasonably related to the value of personal information you have provided.

Changes to this Supplemental Privacy Notice

Any changes to this Supplement Privacy Notice will be made in accordance with our existing Privacy Policy located here.
